Ukrainian music group ZWYNTAR (cemetery) is dissatisfied with the use by the studio “Kvartal 95” of its song without agreement with the change of the text, offers to settle the dispute in a pre-trial order, and otherwise threatens to move the dispute resolution to court.
As noted on the official Facebook page of the group, the studio “Kvartal 95” on 10 May 2025 used the music of the song “Mexican”, creating a derivative work – a parody, and also posted a monetised video of the performance on the platform YouTube.
“On 11 April 2025, we were approached by the music editor of the Quarter and the Laugh League – regarding the opportunity to communicate with us regarding the rights to our song. We replied that we are strongly opposed to the use of our music in projects aesthetically and conceptually not close to us,” the band reports. It is also indicated that the editor was notified that the copyright belongs to the band.
At the same time, on 10 May, the song was used during the concert of the studio “95 quarter”. The studio referred to Art. 21 of the Law “on Copyright”, although ZWYNTAR believes that this does not meet the definition of parody under the law, and therefore is an infringement of copyright.
